A Renewed Regulatory Framework for Electricity

On October 18, 2012, the Ontario Energy Board released its Report, Renewed Regulatory Framework for Electricity Distributors: A Performance-Based Approach (RRFE).

This renewed regulatory approach recognizes the need for significant investment in the sector while acknowledging that concerns over bill increases are leading to a sharper focus on the total cost to consumers.

The RRFE is first and foremost a  regulatory framework that will guide the Board in setting rates for electricity distributors, and ultimately for transmitters. The framework represents a continuing evolution in our focus as regulator. It starts to move that focus from costs and cost recovery to focusing on long-term value for money. The Board recognizes that delivering long-term value for the money consumers spend on electricity is essential to delivering a sustainable energy sector.

The Board’s Report lays out the direction for the new framework and includes a chapter detailing implementation and transition plans. The Board expects the necessary regulatory instruments to be developed by spring 2013, and largely implemented in time for setting May 2014 distribution rates.

The Board’s letter dated November 8, 2011, invited interested stakeholders to participate in a two-day Information Session on the staff discussion papers and consultant reports issued that day.  The session will be held on December 8 and 9, 2011.  The purpose of this informal session is to give participants an opportunity to ask clarifying questions to better understand the documents.  Today, Board Staff posted details regarding stakeholder participation at that session.

July 11-12

The Board issued its Notice of Hearing to determine the cost awards that will be made in accordance with section 30 of the Act in relation to eligible consultation activities that occurred on or before May 31, 2012.  Assuming that the Board does not receive any objections to a written hearing, the hearing will follow the process set out below.

  • Eligible participants shall submit their cost claims by July 25, 2012;
  • Electricity distributors and electricity transmitters will have until August 7, 2012 to object to any aspect of the costs claimed;
  • An eligible participant whose cost claim was objected to will have until August 14, 2012 to make a reply submission as to why its cost claim should be allowed; and
  • The Board will then issue its decision on cost awards.
